Terms and Conditions

These Terms and Conditions (hereinafter referred to as 'T&C') define the terms and conditions applicable to the subscription of the 'Premium' subscription of the mobile application 'Wind Me Up' (hereinafter referred to as the Application), published by Alexis Briot, micro-enterprise, located at Gruissan (hereinafter referred to as the Publisher).

These T&C complement the General Terms of Use (GTU) of the Application. Any subscription to the Premium subscription implies full and complete acceptance of these T&C.

1. Object of the Premium Subscription

The Premium subscription of the Application allows Users to access advanced features, including:

  • The selection of your preferred weather model.
  • More precise wind notifications.
  • The ability to configure multiple notifications simultaneously.
  • The ability to publish multiple classified ads simultaneously.

2. Pricing and Payment Methods

The Premium subscription rates are as follows:

  • Monthly subscription: 3 euros (EUR) per month.
  • Annual subscription: 30 euros (EUR) per year.

The first month of subscription (for the monthly plan) or the first annual period (for the annual plan) may be preceded by a one (1) month free trial period.

2. Payment Methods

Subscription payments are exclusively made through mobile application distribution platforms: Apple App Store for iOS devices and Google Play Store for Android devices.

By subscribing to the Premium subscription, the User accepts the payment terms of the relevant distribution platform (Apple or Google). Transactions are secured by these platforms. The Publisher does not have access to your payment information.

3. Free Trial Period

A one (1) month free trial period is offered to allow you to discover the Premium features.

At the end of this trial period, the chosen subscription will automatically become a paid subscription unless the User cancels it before the end of the trial, in accordance with the subscription management procedures of the Apple App Store or Google Play Store (see article 4.2).

4. Duration, Renewal and Termination of the Subscription

Monthly and annual subscriptions are subscribed for a specific duration (one month or one year) and are automatically renewed at the end of each period for an identical duration, unless terminated by the User.

4.2. Management and Termination by the User

In accordance with platform practices, management (including termination) and cancellation of the subscription are handled directly from your Apple App Store or Google Play Store account settings.

The User must cancel their subscription before the renewal date to avoid being charged for the next period. The termination will take effect at the end of the current subscription period. No refund will be made for the current period.

4.3. Suspension/Termination by the Publisher

The Publisher reserves the right to suspend or terminate, at any time and without notice or refund, the Premium subscription of a User in case of non-compliance with these T&C, the GTU of the Application, applicable laws and regulations, or the terms of use of the Apple or Google platforms.

5. Right of Withdrawal

In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital services not provided on a material medium, the execution of which has begun after prior express agreement of the consumer and express waiver of his right of withdrawal.

By subscribing to the Premium subscription and immediately accessing the advanced features, the User acknowledges and accepts that the execution of the service begins as soon as the subscription is activated (or after the free trial period), and expressly waives his fourteen (14) day right of withdrawal.

6. Price and Service Modifications

The Publisher reserves the right to modify the prices of Premium subscriptions. Any price modification will be communicated to the User by email to the address associated with their account, with sufficient notice before the effective date of the new rates. If the User does not accept the new rates, they may terminate their subscription before the next renewal date.

The Publisher may also modify or remove certain features of the Premium subscription, subject to maintaining a service quality and level of features consistent with what is reasonably expected.

8. Applicable Law and Competent Jurisdiction

These T&C are governed by French law.

In the event of a dispute regarding the interpretation or execution of these T&C, the User undertakes to seek an amicable solution before any judicial action. In the absence of an amicable agreement, the French courts shall have sole jurisdiction.
